Terms and conditions

1. Scope and contracting party

These terms apply to the purchase of licenses for the CarryCat software through this website. The contracting party is [COMPANY_NAME].

2. Subject matter

The subject matter is a perpetual, non-exclusive right to use CarryCat. One license key entitles you to use it on one device. Changing the device is possible; the binding to the previous device is released for that purpose.

Updates that we publish for CarryCat are included in the purchase price.

Adobe Lightroom Classic is required for use; it is not part of the offer.

3. Conclusion of contract

By completing the checkout you make a binding offer. The contract is concluded as soon as we provide the license keys.

4. Prices and payment

The price shown at the time of purchase applies. Payment is made through the payment service provider Stripe using the payment methods offered there. You receive an invoice by e-mail.

5. Delivery

The license keys are shown on the confirmation page immediately after receipt of payment and are sent by e-mail. The software is available for download on this website.

6. Right of withdrawal for consumers

Consumers generally have a 14-day right of withdrawal for distance contracts. For digital content that is not supplied on a tangible medium, this right expires if we begin providing it before the withdrawal period ends with the consumer's express consent and the consumer has acknowledged that the right of withdrawal is thereby lost (Sec. 18(1)(11) FAGG).

We obtain this consent and acknowledgement before the purchase. As the license keys are provided immediately, there is no right of withdrawal once they have been provided.

7. License check

CarryCat checks the license online. Without an internet connection the software remains usable for up to 30 days. If a license key is misused or the purchase price is refunded, we may block the key.

8. Warranty and liability

Statutory warranty provisions apply. We are liable for intent and gross negligence; liability for slight negligence is excluded except for personal injury, towards consumers only to the extent permitted by law.

CarryCat does not replace a backup. You are responsible for regular backups of your catalogs and image data.

9. Final provisions

Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Towards consumers this choice of law applies only insofar as it does not restrict mandatory provisions of the state in which they have their habitual residence.
